Section (1513) of this cowpat of a law states:
(4) Full-time employee
(A) In general
The term “full-time employee” means, with respect to any month, an employee who is employed on average at least 30 hours of service per week. [emphasis mine]
(B) Hours of service
The Secretary, in consultation with the Secretary of Labor, shall prescribe such regulations, rules, and guidance as may be necessary to determine the hours of service of an employee, including rules for the application of this paragraph to employees who are not compensated on an hourly basis. [emphasis mine]
So — 30 hours is now “full time”, meaning small businesses that want to avoid the expense of the “Affordable” Care Act will have to restrict their workers to less than that number of hours (or keep their business from growing beyond 49 employees…) The attention of the law to non-hourly employees allows them to also target salaried and compensation-only workers. What you are looking at is a prescription for a nation of underemployed serfs, working one or two or more part time jobs to get by as businesses seek to protect themselves from tax-hungry bureaucrats…but hey! You’ll have “free” health care, right?
Those multiple part time jobs will men more tax complexity on your returns, and more scrutiny from the revenuers. Won’t that be fun?
What you have is a law written by health insurance companies who sought to force people to buy their product through their cronies in government, who had their own plans for your health care…a plan that would eventually make it too onerous for the insurance companies to operate independently of the government. The goal, as Obama and his stooges have openly admitted, is a national health care service that would place your most valuable property — your body — in their hands; you would be, essentially, property of Uncle Sam. And a powerless bit of property, especially as you will have to come to them for the “assistance” you will need as you scrape to make enough money to survive.
